 Liechtenstein is the only Continental European country to have codified the common law trust.
The establishment of a trust does not create a legal personality. Rather, the trustee undertakes, in relation to the trustor, to manage the assets entrusted to him in accordance with the trust deed.
Although no new legal entity is created as holder of the assets, the assets leave the trustor’s assets and are transferred to the trustee’s assets. The trust is suited, in particular, to establishing succession provisions. A trust can also be created by testamentary provisions, e.g. a will.
